TopNotcher Terms of Use
Effective September 14, 2026
These terms govern your purchase and use of TopNotcher, software licensed by Ferangelo Tuason (the “Developer”). By purchasing, activating, or using the app, you agree to them.
Purchase
TopNotcher is a one-time, tax-inclusive $3.99 USD purchase sold and processed by Polar Software, Inc. as merchant of record. It handles payment, receipts, applicable taxes, and refunds under its Buyer Terms.
License
The Developer grants you a personal, non-exclusive license to use TopNotcher on one active Mac at a time. You may move the license to a different Mac after deactivating the previous Mac. The purchase includes TopNotcher 1.0.0 and all later 1.x updates.
Do not share, publish, sell, or transfer your license key, and do not bypass or interfere with license activation or validation. The app and its intellectual-property rights remain owned by the Developer; your purchase grants permission to use it, not ownership of it.
Activation and availability
Initial activation requires an internet connection. TopNotcher checks the license through its licensing provider when it starts and periodically afterward. A previously validated installation may work offline for up to 30 days before another successful check is required. You can deactivate a Mac from the app or customer portal.
Refunds and termination
Refund requests are handled by the merchant of record under its policies and any rights that applicable law gives you. A refunded, disputed, fraudulent, or revoked purchase may lose its license and download access. A material breach of these terms may terminate this license.
Warranty and liability
TopNotcher is provided as is, without warranties beyond those that cannot legally be excluded. To the extent permitted by law, the Developer is not liable for indirect or consequential loss, and total liability relating to TopNotcher will not exceed the amount you paid for it. These terms do not limit mandatory consumer rights.
Changes and contact
These terms may be updated for future purchases or app changes. An update will not remove the 1.x usage rights already granted with your purchase. The effective date identifies the current terms. Questions may be sent to gelotuason@gmail.com. See the Privacy Policy for data practices.
